Statement About HUAWEI Cloud and Privacy

HUAWEI Cloud is a product (or service) operated by Huawei Software Technologies Co., Ltd. (hereinafter referred to as "Huawei", "we", "us", or "our") that provides you with data sync, device backup, and data storage to allow you to access your data from any of your Huawei devices at any time. We understand the importance of your personal information, and will do our best to protect it. We promise that we will take appropriate security measures to protect your personal information according to established industry security standards.

Please read and understand the Statement About HUAWEI Cloud and Privacy before using this product (or service).

You hereby represent and warrant that you are an adult when you start using this product (or service). If you are a minor, your guardian must agree to your use of this product (or service) and agree to the relevant terms and conditions.

Under normal circumstances, we will reply within one month.

If you are dissatisfied with our response, especially if you feel that our processing or handling of your personal information violates or harms your legal rights and/or interests, you may seek external resolution, whether by filing a lawsuit with the people's court in the relevant jurisdiction, submitting a complaint to the industry self-regulation association or relevant government regulatory agencies, or by other means.

1. How We Collect and Use Your Personal Information

Personal information refers to a variety of information recorded electronically or otherwise that can be used alone or in combination with other information to identify a particular natural person or to reflect the activity of a particular natural person.

Sensitive personal information includes personal identification number, personal biometric information, bank account number, property information, whereabouts, transaction information, and the personal information of children aged 14 years and younger.

We will only collect and use your personal information for the following purposes described in this Statement:

1.1Providing you with the following core functions:

1) Cloud sync: You can use the Cloud sync function to automatically sync data in your Gallery, Contacts, Calendar, Notepad (including images and voice memos), WLAN settings, Browser bookmarks, as well as cards and coupons data in HUAWEI Wallet to the cloud service servers and to any other devices that have been logged in to your account. Any changes to your data on either the device or cloud will trigger synchronization, keeping the data on the device consistent with those on the cloud.

In order to provide you with the Cloud sync function for the aforementioned data, we shall collect your following information:

– Device information: including unique device identifier, operating system, device model, and network connection mode;

– Account information: including phone number and email address;

– Any data you choose to sync: may include data in your Gallery (photos and videos), Contacts, Calendar, Notepad, WLAN settings, Browser bookmarks, as well as cards and coupons data in HUAWEI Wallet.

Among these, phone number, email address, and browser bookmarks are sensitive personal information.

The purpose of collecting the aforementioned information is to provide users with the ability to sync data across multiple devices using the same HUAWEI ID.

The data you choose to sync will be encrypted and stored on the server and synchronized through an encrypted channel between the server and each device. Without your account and password information, your data cannot be accessed by others. Huawei shall never disclose your personal information to any company, organization, or individual other than Huawei without your express consent unless otherwise required by law.

If you do not provide the aforementioned information, you will not be able to use the Cloud sync function. To disable the Cloud sync function for a certain data, enter the home screen of Cloud. After the function is disabled, the device will stop the uploading and synchronization of the data.


2) Cloud backup: When you log in to HUAWEI Cloud, the Cloud backup function will be enabled automatically. You can use the Cloud backup function to back up your device's data to HUAWEI Cloud, and then access your data at any time on other Huawei devices, and make the process of replacing your device simpler and easier. Whenever the device is charging, connected to a WLAN network, and the screen is locked, the Cloud backup function will create an automatic backup of your data. If the device has not backed up its data to the cloud service for 180 days, Huawei reserves the right to delete any backups related to the device.

In order to provide you with the Cloud backup function for the aforementioned data, we shall collect your following information:

– Device information: including unique device identifier, operating system, device model, and network connection mode;

– Account information: including phone number and email address;

– Any data you choose to back up: including data in your Gallery, Contacts, Messaging, Call log, Notepad, Recordings, Settings, Weather, Clock, Camera, input methods, Browsers, Phone Manager, WLAN, FM Radio, SmartCare, home screen layout, and apps (data from third-party apps will not be backed up). Among these, phone number, email address, call logs, and browser bookmarks are sensitive personal information.

The purpose of collecting the aforementioned information is to help users back up their device data to HAUWEI Cloud.

The data you choose to back up will be encrypted and stored on the server. Without your account and password information, your data cannot be accessed by others. Huawei shall never disclose your personal information to any company, organization, or individual other than Huawei without your express consent unless otherwise required by law.

If you do not provide the aforementioned information, you will not be able to use the Cloud backup function. To disable the Cloud backup function, go to Cloud > Cloud backup. After the function is disabled, the device will stop the uploading and backing up of the aforementioned data.


3) Huawei Drive: When you log in to HUAWEI Cloud, the Huawei Drive function will be enabled automatically. You can enter the Huawei Drive screen to upload your local files to HUAWEI Cloud, and then access or download your files from any device. The Huawei Drive function does not automatically upload your files. You will need to manually add files to Huawei Drive.

In order to provide you with the Huawei Drive function for the aforementioned data, we shall collect your following information:

– Device information: including unique device identifier, operating system, device model, and network connection mode;

– Account information: including phone number and email address;

– Any local files you choose to upload.

Among these, the phone number and email address are sensitive personal information.

The purpose of collecting the aforementioned information is to help users upload their local data to HUAWEI Cloud associated with their accounts.

The data you choose to upload will be encrypted and stored on the server. Without your account and password information, your data cannot be accessed by others. Huawei shall never disclose your personal information to any company, organization, or individual other than Huawei without your express consent unless otherwise required by law.

If you do not provide the aforementioned information, you will not be able to use the Huawei Drive function. To disable the Huawei Drive function of HAUWEI Cloud, log out of your HUAWEI ID. After the function is disabled, you will not be able to access the content in Huawei Drive or add files to Huawei Drive on the device.


4) More app data: By touching More, you can enable auto-uploading of SMS messages, call log, recordings, and blocked data. When data of such type is updated on your device, it will automatically be uploaded to HUAWEI Cloud, and then can be downloaded to local when needed.

In order to provide you with the auto-uploading function for the aforementioned app data, we shall collect your following information:

– Device information: including unique device identifier, operating system, device model, and network connection mode;

– Account information: including phone number and email address;

– Any data you choose to upload, including SMS messages, call log, recordings, and blocked data.

Among these, phone number, email address, SMS messages, and call logs are sensitive personal information.

The purpose of collecting the aforementioned information is to help users automatically store their data to HUAWEI Cloud.

The data you choose to upload will be encrypted and stored on the server. Without your account and password information, your data cannot be accessed by others. Huawei shall never disclose your personal information to any company, organization, or individual other than Huawei without your express consent unless otherwise required by law.

If you do not provide the aforementioned information, you will not be able to use the More app data function. To disable the auto-uploading function for the aforementioned data, go to Cloud > More. After the function is disabled, the device will stop the auto-uploading of the aforementioned data.


5) Find my phone: When you log in to HUAWEI Cloud, the Find my phone function will be enabled automatically. After the Find my phone function is enabled, you can locate device, play ringtone, lock device, and erase data on your device, therefore prevent your device from being wiped or reactivated without your HUAWEI ID and password. You can visit the official HUAWEI Cloud website (cloud.huawei.com) or use other Huawei devices to open the Find my phone app to locate device, play ringtone, lock device, and erase data on your device.If you choose to enable the Find my phone function and use it to locate or lock your device, we shall collect your following information:

– Device information: including unique device identifier, operating system, and device model;

– Location information: including GPS positioning and network-assisted positioning data.

Among these, the location information is sensitive personal information.

The purpose of collecting the aforementioned information is to help users locate their devices and display the location information of their devices on the map.

Your location information will be encrypted and stored on the server. Without your account and password information, your data cannot be accessed by others. Huawei shall never disclose your personal information to any company, organization, or individual other than Huawei without your express consent unless otherwise required by law.

If you do not provide the aforementioned information, you will not be able to use the locating and locking device functions. To disable the Find my phone function, go to Cloud > Find my phone. After the function is disabled, it will stop collecting of the aforementioned data on your device.

If you provide phone number or email address, it will help us to provide you with better services and experience. When you perform offline locating, issue lock or erase command, you can provide your phone number or email address. After the command is executed successfully, an SMS message or an email will be sent to you to inform you about this. Your use of the service's standard functions will not be affected if you do not provide the aforementioned information.

When you use the Remote unbinding feature in Find my phone, we may need to collect your following information: name, phone number, unlock password, the purchase invoice of your device, photos of the retail packaging box, HUAWEI ID information (including your nickname and registration time), storage purchase records and order number in Cloud.

We will use your personal information in the following way: the aforementioned information will only be used for identity verification. Please provide accurate information to ensure that your unbinding request will be well accepted.


6) Official HUAWEI Cloud website: You can visit cloud.huawei.com to manage the data that has been stored in HUAWEI Cloud and to use the Find my phone function.

Your following data will be collected onto the server when you use functions related to official HUAWEI Cloud website: browser information (for example, browser type, time zone, plug-ins, language, and font), IP address, and mouse and keyboard operations information on the page. And cookies and local storage will be used.

If you do not provide the aforementioned information, you will not be able to use the functions related to HUAWEI Cloud website normally. To exit Cloud website, touch the drop-down menu beside your nickname in the upper right corner of the website, and touch Log Out. After you exit the website, it will stop collecting of the aforementioned data.


7) When you purchase additional HUAWEI Cloud storage space by using HUAWEI Wallet secure payment, we need to collect your purchase records, including package information (name, capacity and duration), time of purchase, and order ID, to ensure you can enjoy the privileges of the paid service. Purchase records are considered sensitive personal information. If you haven't purchased any Cloud storage, we will not retain any of the aforementioned records.


8) When you participate in an event and win physical prizes, we need to collect your following information: phone number, address, and contact information. Among the information collected, your phone number is sensitive personal information. The purpose of collecting such information is so that we may contact you and deliver the corresponding prizes. If you do not provide such information, you will not be able to receive physical prizes, but your normal use of other HUAWEI Cloud features will not be affected.


1.2Providing you with the following additional services:

Issues and suggestions: To provide suggestions or report issues on our product, go to Cloud > Settings > Feedback.

When you use the function, we shall collect your following information:

– Issue description, including the issue you entered and any screenshots you added;

– Contact information, including phone number and email address;

– App logs, including operation logs and error logs of the app.

Among these, the phone number and email address are sensitive personal information. The purpose of collecting such information is to help you locate the issue and contact you for further information and feedback on the progress of the issue.

Any issues that you report in Issues and suggestions will be encrypted and stored on the server and deleted automatically after six (6) months.

If you do not provide the aforementioned information, you will be unable to use the Issues and suggestions function, but your use of the service's standard functions will not be affected.

If we want to use the information for other purposes not specified in this Statement, we will seek your prior consent.

If we want to use information collected for a specific purpose for other purposes, we will seek your prior consent.

2. User-Personalized Recommendations and Advertising

We may undergo user analysis using some of your personal information in order to provide you with better experience and personalized services, such as function improvements and bug fixes. To disable the personalization function, go to Settings > System > User experience improvement and then uncheck Join the User Experience Improvement Program.

Such personal information includes: your device information (operating system, device model, network mode, screen resolution, and system language), Cloud usage, operation logs, system logs, and error logs.

We may use some of your personal information to send you commercial advertisements that may be of interest, including but not limited to showing you events, prizes, comments, etc. in your notification panel or sending notifications of new services and recommendations to you by email or SMS message. To unsubscribe from these commercial advertisements, go to Cloud > Settings, and disable Notifications.

Such personal information includes: your device information (operating system, device model, network connection mode, resolution, and system language), Cloud usage, operation logs, and system logs.

3. Provide Your Personal Information to Third-Party Service Providers

The prizes you win in the service are issued by Huawei, and will be delivered to you by third-party logistics providers, for which we need to provide your following personal information: address, phone number, and contact information.

4. Your Data Subject Rights

In order for you to more easily access, amend, and delete your personal information during the course of using HUAWEI Cloud and guarantee you the right to withdraw your consent regarding personal information usage, we have added the relevant operating settings in the product. Refer to the following guidelines for details.


4.1 Access personal information

To access your Cloud sync and Huawei Drive data, go to Cloud > Manage storage, or log in to HUAWEI Cloud website (cloud.huawei.com). To access your Cloud backup data, you need to select the Cloud backup records you want to view and restore them to your Huawei device for review.


4.2 Modify personal information

You can modify your data uploaded to HUAWEI Cloud by logging in to the HUAWEI Cloud website (cloud.huawei.com).

Once you enable data sync on your device, any changes to your Gallery (photos and videos), Contacts (contacts and groups), Calendar (events), Notepad (memos and tags), WLAN settings (WLAN password), and Browser (bookmarks and subscribed channels) will also be synced to Cloud and any other devices that have enabled data sync.

You can modify your contact information submitted for prize claim by contacting HUAWEI Cloud customer service at hwcloud@huawei.com.


4.3 Delete personal information

To delete any of your uploaded data on HAUWEI Cloud, go to Cloud > Manage storage, or log in to HUAWEI Cloud website (cloud.huawei.com).

In addition, should you deregister your HUAWEI ID, the data stored to HUAWEI Cloud by that account will also be deleted. To delete your HUAWEI ID, go to HUAWEI ID > Security center > Delete account.

You can delete your prize-claiming contact information by contacting HUAWEI Cloud customer service.


4.4 Privacy-related function settings

When you use HUAWEI Cloud services, we may display marketing and event messages in the notification panel. To disable the function, go to Cloud > Settings, and disable Notifications.

If you have any questions, comments, or suggestions on your data subject rights, please contact us using the contact information provided in this Statement and exercise your rights.

5. Data Storage Location and Period

5.1 Data storage location

The personal information we collect and generate under this service will be stored in the People's Republic of China.


5.2 Data storage period

We shall store your personal information only for the time necessary to achieve the purpose of its collection, and delete or anonymize your personal information beyond the time set out below, except as otherwise required by applicable laws and regulations.

In HUAWEI Cloud's Cloud sync, Cloud backup, More app data, Huawei Drive, Find my phone services, and the official Cloud website, the specific storage period for your personal data is as follows:

Should you deregister your HUAWEI ID, HUAWEI Cloud will permanently delete any and all your data, files and stored content of that account within six (6) months.

If you do not use HUAWEI Cloud for twelve (12) consecutive months, Huawei is entitled to cease the provision of the service to you and reserves the right to delete all content stored under the service.

In user-personalized recommendations and advertising, your device information (operating system, device model, network connect mode, resolution, and system language), Cloud usage, operation logs, and system logs will be deleted immediately upon completion of the relevant statistical analysis; error logs will be automatically deleted after seven (7) days.

Your purchase records will be retained for seven (7) years, and deleted after obtaining your agreement.

Your prize-claiming personal information (including your phone number, address, and contact information) and information submitted for remote unbinding will be deleted immediately upon your request.

In addition, if we discontinue our products or services, we will notify you in the form of a push notification, announcement, or other means, and delete your personal information or anonymize it within a reasonable period of time.

6. Updates to this Statement

Huawei reserves the right to update this Statement in due course. When any changes are made to this Statement, we will release an announcement on HUAWEI Cloud website and send you a change notification in the form of a pop-up dialog box in the app. We will only collect, use, and store your personal information in accordance with the updated statement with your consent.

This Statement takes effect as of the date of the update.
